Baker & Daniels has significant experience in occupational safety and health laws. The broad range of services we provide include:
- General counseling on compliance with federal and state occupational health and safety laws and standards
- Counseling during OSHA and IOSHA investigations, particularly with an employers' need to furnish information to government investigators and the government's need to obtain search warrants
- Representing employers investigated or cited for violations before OSHA and IOSHA, particularly during informal conferences
- Defending employers in adjudicatory proceedings before the Occupational Safety and Health Review Commission and Indiana Board of Safety Review on alleged violations;
- Designing employee safety programs and hazard communication programs, including SARA Title III compliance
- Supervising occupational safety and health compliance audits, particularly in connection with the sale of a business or facility
- Representing and counseling trade associations and employers in OSHA rulemaking proceedings
- Counseling and assisting in litigation and employment proceedings on employee exposure to toxic substances
- Defending worker's compensation claims
Baker & Daniels' experience includes counseling administrative proceedings and/or litigation on standards that include hazard communication, noise, coke oven, lead, power press, respiratory protection, ventilation, flammable and combustible liquids, powered industrial trucks and cranes, electrical, asbestos, employee medical and exposure records, and construction safety (particularly those concerning scaffolding, safety nets, belts, and rigging and trenching). We represent employers in highway and building construction industries, including acting as counsel to the Associated General Contractors of Indiana on OSHA and IOSHA matters. Our group represents employers in the industries that include iron, steel and brass foundries, basic and stainless steel, petroleum and chemical refining, printing, metal fabrication and electrical equipment.
