Professional Experience
Kathy Osborn is a commercial, antitrust and appellate litigator and an antitrust compliance counselor. She represents businesses and individuals in state and federal courts in an array of substantive areas, including antitrust, estate/probate/trust, product liability, administrative procedure, contract and torts. Kathy has significant experience in multi-district litigation proceedings and complex antitrust litigation. She regularly counsels business entities with regard to various antitrust matters, including practices and conduct under the Sherman, Clayton and Robinson-Patman Acts and comparable state laws.
Kathy is recognized for her creativity in the litigation and appellate arena. That creative knack is further evidenced by her selection by Whirlpool for a Mother of Invention Award. She also has been a regular author and commentator on civil litigation cases for the Indiana State Bar Association's journal, Res Gestae, since 2000. Kathy is a former co-editor of Baker & Daniels' Litigation Newsletter.
Before joining Baker & Daniels, Kathy clerked for Justices Frank Sullivan, Jr. and Myra C. Selby of the Indiana Supreme Court, which provided her with a strong foundation for her appellate practice. Before becoming a lawyer, Kathy worked 11 years for Indiana University’s Institute on Disability and Community. She secured grants, managed systems change efforts, conducted research and training on organizational change and inclusion, and supported schools and community organizations to include people with disabilities.
Indiana Judicial Nominating Commission / Indiana Commission on Judicial Qualifications Candidate
In October 2010, Kathy will be on the ballot for the 2nd District attorney position on the Indiana Judicial Nominating Commission and Commission on Judicial Qualifications. She is excited about this opportunity on many levels and believes she is uniquely qualified to serve in this capacity because of her professional experience, background and knowledge of the Indiana judicial system. She also would be honored to serve as the first female attorney elected to the Commissions. Kathy believes she would bring a balanced perspective to the Commissions in that she is not solely a plaintiff's lawyer, nor solely a defense lawyer. She desires to be a true representative.

- Represented individuals and fiduciaries in guardianship and estate matters, including but not limited to, will contests and breach of fiduciary trust claims.
- Represented ATA in Hart Scott Rodino and antitrust matters.
- Represented Cessna Aircraft Company in contract, franchise and associated arbitration clause matters.
- Represented Cummins, Inc. in personal injury and product liability matters and provides antitrust compliance counseling.
- Represented Eli Lilly and Company in thimerosal/product liability cases and provides antitrust compliance counseling.
- Represented Indiana University in Access to Public Records Act and Open Door Law matters.
- Represented Indianapolis Public Schools in employment and education matters.
- Represented Kerasotes Theatres, Inc. in antitrust matters under state and federal law.
